GrowDoc App Inc. (hereinafter “we”, “us” or “our” as applicable) is dedicated to ensuring that your personal information is kept private and not disclosed in an unauthorized manner. We are committed to respecting the privacy of every user that uses our website or mobile application, including related features, products and services (collectively referred to as the “Platforms”). We also respect the privacy of every person whose personal information may be processed as a result of others’ use of our services (hereafter the “Services”).  Although our Platforms do not collect substantial personal data from its users, we will explain what data we collect, what we do with the collected data, and the rights you may have in regard to the data.

 

TL;DR: Hello, we’re from Canada. To sign up, you will need to provide a username and an email address for convenience. It’s just for sign up & important notifications. No spam. We won’t sell or give this information to anyone else. When you use our Services, you’re trusting us with your personal data. We take pride in being a security & privacy service accessible to everyone that collects as little user personally identifiable information (only the absolute bare minimum such as your email address and browser information cookies) as possible, based on your use of the Services. GrowDoc is an anonymous platform and no third parties will have access to your personal information other than what this privacy policy provides. We rely on other companies, paypal and Apple Pay to process payments.

 

1.   What is the purpose of the Privacy Policy?

 

Our Privacy Policy explains which personal information we may obtain about you from you or a third-party and the purposes for which we may collect such information. The Privacy Policy also explains your rights in respect to how your personal information is processed. The Privacy Policy aims to comply with all applicable data privacy laws (hereinafter “Data Privacy Laws”), as defined further in the Privacy Policy.

 

The Privacy Policy informs you of the nature of the information we collect and process and how you can request that we delete, update, transfer and provide you access to it.

 

The Privacy Policy should be read in conjunction with our Terms of Service. The Privacy Policy only applies to the use of your personal information by us and does not apply to the personal information collected by third parties with whom we are not affiliated.

2.   Who is GrowDoc App Inc. and what do we do?

 

GrowDoc App Inc. is a Canadian corporation established in the province of New Brunswick. It was created to help users identify the cause of sick Cannabis plants and tell them what is needed to fix it. We are the data controller responsible for processing your personal information.

4.   What data do we collect?

 

When collecting personal information from you, we aim to (i) verify your identity when logging in, (ii) help us deliver our Services, (iii) improve and develop new Services, (iv) carry out requests you’ve made on the Platforms or in regards to our Services, (v) investigate inquiries or disputes, (vi) comply with any applicable law, (vii) enforce our agreements with you, and (viii) protect our rights, property or safety and that of our customers, subscribers, users or third parties.

 

To do so, we may collect the following personal information from you:

 

  •   Your username to access the Platforms and Services;

  •   Your email address (if you provide it);

  •   Your IP address saved by our Web server logs;

  •   User preferences (if you provide them);

  • Other data collected using Google Analytics by Google, Inc.;

  • Other information as may be requested by us with your consent in relation to the provision of Services;

  • Third-party monitoring related to web traffic;

5.   How do we use electronic communications protocols and cookies ?

 

In order to create profiles of our users, we may store information through cookies, log files, and third parties. A profile is stored information on individual users that detail their viewing preferences. We use this information to improve our Services and the content of the Platforms for the user. We do not share your profile with any other third parties.

 

Cookies. A cookie is a piece of data stored on the user’s computer tied to information about the user. Usage of a cookie is in no way linked to any personally identifiable information while using our Platform. GrowDoc App Inc. uses cookies in order to enhance its users’ experience on our Platforms. For example, by setting a cookie, users to not have to log in a password every time they connect to the Platforms.

 

We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user’s hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions.

 

Users can generally disable the cookie feature on their browser without affecting their ability to use the Platform, except in some cases where cookies are used as an essential security feature necessary for transaction completion. While we do not offer an opt-out option for cookies directly on the Platform, your browser will provide you with information and control over cookies. You can set your web browser to alert you when a cookie is being used, as well as obtain information on the duration of the cookie and what server your data is being returned to. You have the choice to accept or reject the cookie on your browser. Moreover, you have the option to set your browser to refuse all cookies or to only accept cookies that are returned to the originating servers.

 

6.   How do we use your data?

 

Access to the Services. Your name, username, email address and password may be collected and used to enable you to access the Platforms and enable us to perform the Services.

 

Customer support. If you communicate with us to obtain customer support, we may temporally collect contact data and information with your consent in order to render Services, updates, support or similar notices to you.

 

Information and marketing. With your consent, we may use the data provided to send you notices and online newsletters. We may also use your information to provide you with pertinent notices regarding product releases and service developments.

 

On rare occasions it may be necessary we send out a strictly service-related announcement. For instance, if our Service is temporarily suspended for maintenance, we may send users an email.

 

Improving our Services. We may use collected data to help us create content and navigation on our Platforms that is most relevant and user friendly. This includes data collected as a result of site navigation or data provided in forms with your consent.

 

Like most standard web site servers, we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Platform, and gather broad demographic information for aggregate use. These log files are not linked to personally identifiable information.

 

Legal obligations. Data may be used to respond to law enforcement organizations, government officials, or third parties when compelled by subpoena, court order, or applicable law. We will notify you of the information request or submission as, and if, allowed.

 

Ads. We may use information derived from cookies, location (provided you allow it) or your behavior on the Platforms for us or third parties to target certain ads towards you while using the Platforms. Information about users’ visit to the Platforms, such as the number of times they have viewed an ad (but not username, email or other personal information) is used to serve ads to users on the Platforms. We may also use third-party advertising companies to serve ads when you visit our Platform. These companies may use information (excluding your name, email or other personal information) about your visits to the Platforms in order to provide advertisements about goods and services of interest to you.

 

7.   Does GrowDoc App Inc. collect any financial data?

 

No. We use third-party payment processors to process all financial transactions. GrowDoc App Inc. is not provided with any data or personal information related to your transaction.

 

8.   With who do we share your personal information?

 

GrowDoc App Inc. only shares your data for the limited marketing purposes set forth in the Privacy Policy and with other third-party vendors for the purposes of performing the Services and operating the Platform.

 

Vendors. Vendors that are performing maintenance on the Platforms may have limited temporary access to your personal information.

 

Third-party payment processors. We may provide your personal information to third-party payment processors for the purpose of providing the Services to you.

 

Social networks. If you decide to link your profile to social networks such as Facebook, Instagram or LinkedIn, you may be sharing your personal information with these networks in which case such information shall also be governed by these networks’ respective Privacy Policies.

 

Legal obligations. We may need to share your personal information for the purpose of disclosing to law enforcement if required by law. If you so desire, you may minimize the risks of submitting personally identifiable information, if any, to GrowDoc App Inc. by using a disposable and temporary e-mail address to sign up and/or using a virtual private network (VPN) to use our Services.

 

9.        Are there any other circumstances within which my personal information may be shared?

 

Business transitions. If GrowDoc App Inc. goes through a business transaction, such as a merger, an acquisition by another company, or selling a portion of its assets, users’ personal information may be part of the assets transferred. Users will be notified prior to a change of ownership or control of their personal information. If, as a result of the business transition, the users’ personally identifiable information will be used in a manner different from that stated at the time of collection, they will be given a choice to opt-out of the Services and to have their personally identifiable information deleted.

 

Third-party marketing. We may use third-party advertising companies to serve ads to you when using the Platform. These companies may use information, including your location data (provided you have allowed it) (but excluding your name, email or other personal information), about your visits to the Platforms or other websites in order to provide advertisements on the Platforms about goods and services that may be of interest to you.

 

10.  How do we obtain your consent?

 

When GrowDoc App Inc.’s use of your personal information requires your consent, you can provide such consent (i) at the time we collect your personal information following the instructions provided, (ii) by informing us by email using the contact details set out in the Privacy Policy in the “How to Contact Us” section above, or (iii) at the time you allow us to collect your location data.

 

 

11.   What are my rights in regard to GrowDoc App Inc.’ use of my personal information?

 

Choice/Opt-out. When asked for personal information, each user is given the choice to “opt-out” of having their information used for purposes not directly related to the Platforms. For example, when you purchase a Service, our order form will have an “opt-out” mechanism so that you may refuse to receive any marketing material through the email address provided. Additionally, users who no longer wish to receive our newsletters or promotional communications my opt-out of receiving those communications at any time with the “unsubscribe” link contained in the email.

  

Correcting, updating, deleting and deactivating your personal information. If a user’s personally identifiable information changes, such as their email or any other personal information provided, or if a user no longer wishes to subscribe to the Services, we provide a way to correct, update, delete or deactivate this information. This can be done in the user’s setting page within the Platforms or by emailing us at the email address provided in the “How to Contact Us” section of the Privacy Policy.

 

Additional rights under Data Protection Laws. You may have additional rights in regard to Data Protection Laws depending on your citizenship status. In compliance with applicable Data Privacy Laws as defined herein, you may request to view or have your personal information and data deleted from the Platforms by contacting us via the email listed above in the “How to Contact Us” section. GrowDoc App Inc. will respect and comply with your request within a reasonable delay, as required by the applicable Data Protection Laws.

 

Depending on your citizenship status, you may have additional rights, including the rights to:

 

  •   Access your personal information data;

  •   Rectify the data if it is incomplete;

  •   Restrict the processing of your data;

  •   Object to the processing of your data;

  •   File complaints with a supervising authority; and

  •   Withdraw your consents to our use of your data.

 

12.                How long do we keep your personal information for?

 

We retain your personal information for as long as we have an ongoing legitimate business or legal need to do so, in compliance with our obligations under the applicable Data Privacy Laws. Our retention period will vary depending on the type of data involved. Generally, we will refer to the following criteria in order to determine the applicable retention period:

 

  •   Whether we have a legal or contractual need to retain the data;

  •   Whether the data is necessary to provide our Services;

  •   Whether our Users have the ability to access and delete the data within the Platforms;

  •   Whether our Users would reasonably expect that we would retain the data until they remove it or until their accounts are closed or deactivated; and

  •   Whether we have an ongoing legitimate business need to process your personal information – when that is no longer the case, we will either delete or anonymize it.

 

13.                 How does GrowDoc App Inc. protect my information?

 

When users submit personal information via the Platforms, their information is protected both online and offline. The personal information that is provided is stored on servers, which are located in secured facilities with restricted access, and protected by protocols and procedures designed to ensure the security of such information. We also restrict access to personal information to the Provider’s employees, independent contractors and agents who require certain information in order to develop, operate and maintain the Services. These third parties maintain the same level of appropriate administrative, physical, and technical safeguards for protection of the security, confidentiality and integrity of your personal information. While we strive to protect user information, no server, computer or communications network or system, or data transmission over the Internet can be completely secure. Hence, we cannot ensure or warrant the security of any information you transmit to us through use of the Services and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk.

 

14.                What about the photos submitted by users to the Platforms?

 

We encourage all users to avoid sending pictures that may be used to identify themselves. Please only upload pictures of Cannabis plants.

 

15.                How do we handle updates to our Privacy Policy?

 

We may update the Privacy Policy from time to time to describe how new features to the Platforms affect our use of your data and to let you know of new control and preference features that we provide.

 

If we update our Privacy Policy, we will notify you immediately so that you are always made aware of what information is collected and how we use it. We will use information in accordance with the Privacy Policy under which the information was collected.

 

16.                What are Data Protection Laws?

 

For the purposes of this Privacy Policy, Data Protection Laws refer to any applicable data protections laws relating to the protection of individuals with regards to the processing of personal data, including (i) the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”), (ii) the General Data Protection Regulation (EU) (“GDPR”), and/or (iii) any corresponding or equivalent national laws or regulations including any amendment, update, modification to or re-enactment of such laws.
